It's a bit annoying how many news outlets just parrot the @EUCommission and #Meta line today that the latter is now going to offer a "less personalised" version of #Facebook and #Instagram using "less personal data" in order to comply with the #DigitalMarketsAct.

Have they actually read the Regulation?

@ilumium @EUCommission Yes! 馃挴 I've been wondering on Bluesky why they even bothered to announce anything when it's not even clear what changed from the old less-personalized (but still non-compliant) option: https://bsky.app/profile/gateklons.bsky.social/post/3m7ilbrr4fs2s

The #DMA says in Article 5(2) that gatekeepers are prohibited to "combine personal data from the relevant core platform service [=Facebook, Insta] with personal data from any other services [Meta Ads] provided by the gatekeeper or with personal data from third-party services [ad partners]" without consent as defined by #GDPR.

Now GDPR consent needs to be free, informed, and specific to the data processing.

So, as long a users have not specifically and knowingly consented to it...

...#Meta is prohibited from combining or cross-using that user's personal data from Fb and Insta with data for #advertising.

As far as #DMA and #GDPR are concerned, no consent doesn't mean "less personal data", it means NO PERSONAL DATA processing for ads.

I sincerely hope the Commission will make this clear to the #gatekeeper.
